1. Terms of Use

Governing Law

PC LAN controls and operates this website from its office in Australia. These Terms & Conditions are governed by the laws of New South Wales, Australia. You and PC LAN submit to the non-exclusive jurisdiction of the courts of New South Wales. If you access this website from another location, you are responsible for complying with applicable local laws.

Revisions to These Terms

PC LAN may revise these Terms & Conditions by publishing an updated version on this website. Any revised terms apply from the date they are published and will not retrospectively change the terms governing an order already accepted by PC LAN, unless required or permitted by law or agreed with you. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Site Content, Ownership & Use Restrictions

The material on this website is protected by copyright and other intellectual property laws in Australia and other countries.

Unless otherwise indicated, all rights, including copyright, in the text, graphics, logos, button icons, video, audio, software, layout and other content used to create or support this website (collectively, the "Content") are owned or controlled by PC LAN or its related companies, affiliates, licensors or licensees.

The name "PC LAN" and associated branding may not be used without our prior written permission.

Personal, Non-commercial Use

You may display, download and print reasonable portions of this website solely for:

  • placing an order with PC LAN; or

Prohibited Conduct

Your permission to use the website and its Content may be suspended or terminated if you breach these Terms & Conditions.

Protecting Your Login Details

You are responsible for keeping your username and password confidential and for activity conducted through your account, except to the extent that responsibility cannot lawfully be imposed on you. You must notify PC LAN promptly if you become aware of unauthorised use of your account. PC LAN may suspend or restrict an account where reasonably necessary to protect the customer, PC LAN or other persons, investigate suspected misuse, or comply with law.

Security & Privacy

PC LAN handles personal information in accordance with its Privacy & Security Policy and applicable law. PC LAN may disclose personal information to service providers where reasonably necessary to process payment, fulfil an order, deliver goods, provide support, prevent fraud or comply with legal obligations.

Feedback

If you voluntarily provide ideas, suggestions or other feedback to PC LAN, you grant PC LAN a non-exclusive, worldwide, royalty-free licence to use and adapt that feedback for the purpose of operating and improving its business, products and services. This does not transfer ownership of your pre-existing intellectual property or limit rights that cannot lawfully be limited.

General Prohibitions

You must not upload, post, transmit or otherwise make available through the website any material that:

  • violates or infringes another person's rights, including privacy and intellectual property rights;
  • is unlawful, threatening, abusive, defamatory, obscene, harassing or likely to incite hatred;

Indemnity

To the extent permitted by law, you indemnify PC LAN against third-party claims, losses, damages and reasonable costs arising directly from your unlawful use of this website, your material breach of these Terms & Conditions, or your infringement of another person's rights. This indemnity does not apply to the extent that a claim or loss was caused or contributed to by PC LAN's negligence, breach of contract or unlawful conduct.

2. Buying Products from Our Website

Payment Policy

PC LAN accepts the payment methods displayed at checkout or otherwise approved by PC LAN. Unless you have an approved credit account with PC LAN, full cleared payment must be received before goods are dispatched or made available for collection.

For backorders, pre-orders, special-order items and products ordered specifically for a customer, full payment or a deposit may be required before PC LAN places the order with its supplier.

The authorisation, processing or receipt of payment does not by itself constitute acceptance of your order by PC LAN.

If PC LAN cancels an order before acceptance, any amount paid for the cancelled item will be refunded to the original payment method, subject to applicable law.

Orders and Acceptance

When you place an order through the PC LAN website, by email, over the phone or by another method, your order constitutes an offer to purchase the relevant goods or services from PC LAN.

An automated order confirmation, payment receipt, tax invoice, acknowledgement email or other automatically generated communication confirms only that we have received or are processing your order. It does not necessarily mean that PC LAN has accepted your order.

PC LAN may verify the price, product information, stock availability, payment details, delivery details and other relevant information before accepting an order.

Unless PC LAN expressly advises otherwise, an order is accepted and a contract of sale is formed when PC LAN first:

  • dispatches the goods and sends a dispatch confirmation;
  • confirms that the goods are ready for collection; or
  • otherwise expressly confirms acceptance of the order.

Before an order has been accepted, PC LAN may reject or cancel the affected item or order where reasonably necessary because:

  • a genuine pricing or promotional error has occurred;
  • incorrect product information has been displayed;
  • an incorrect product, model, part number, specification, image, discount, promotion or bundle has been listed;
  • stock information was incorrect or the product is unavailable;
  • a supplier or manufacturer has discontinued, withdrawn or materially changed the product;
  • a manufacturer, supplier or third-party data feed has supplied incorrect information;
  • there is a payment, security, identity-verification or suspected fraud issue;
  • the order exceeds an applicable purchase or quantity limit; or
  • another genuine technical, system, typographical or human error has materially affected the order.

If PC LAN cancels an item or order in these circumstances after receiving payment but before acceptance, PC LAN will refund the amount paid for the cancelled item. Where appropriate, PC LAN may instead notify you of the corrected information and invite you to proceed.

PC LAN may restrict sales to reasonable retail quantities, including where an order appears to be placed for resale or distribution.

Purchasing & Payment

For each order, you must pay:

  • the applicable price for the relevant goods confirmed by PC LAN; and
  • any delivery, handling, surcharge or other charge clearly disclosed before purchase.

Payment information submitted online is processed using the payment facilities made available by PC LAN and its payment service providers. Cash on delivery is not accepted. Payment must clear before dispatch or collection unless you have an approved credit account with PC LAN.

Special Orders and Deposits

PC LAN may require a deposit, including a deposit of up to 20%, for special-order, custom-configured or customer-specific goods. If you cancel because you have changed your mind, PC LAN may retain or apply the deposit only to the extent permitted by law and reasonably necessary to cover costs or losses incurred as a result of the cancellation. This clause does not limit your rights under the Australian Consumer Law.

Pricing & Price Changes

PC LAN regularly updates its website to provide current product information, availability and pricing. The price displayed when you submit an order is the price on which your offer to purchase is based, subject to verification and acceptance by PC LAN.

Prices may change at any time before an order is accepted due to factors including supplier or manufacturer pricing, exchange rates, promotions, stock availability and market conditions.

A reduction in the advertised price after an order has been accepted does not entitle the customer to a refund or credit for the difference, except where required by law or expressly agreed by PC LAN. Similarly, PC LAN will not increase an agreed price after accepting an order solely because the general advertised price later increases, except where agreed with the customer or permitted by law.

PC LAN may correct genuine pricing, promotional, product and specification errors caused by typographical, technical, system, supplier, third-party data-feed or human error.

Pricing Errors

PC LAN takes reasonable care to ensure prices displayed on its website, quotations and other sales materials are accurate. However, genuine errors may occasionally occur, including:

  • typographical, data-entry or decimal-placement errors;
  • incorrect discounts, promotions or GST calculations;
  • technical, software, website or system errors;
  • supplier, manufacturer or third-party data-feed errors;
  • incorrect product-to-price, SKU or model mapping; or
  • other genuine human or technical errors.

If PC LAN identifies a genuine pricing error before accepting an order, PC LAN may:

  1. notify you of the correct price and give you the option to proceed at that price; or
  2. cancel the affected item or order and refund any amount already paid for it.

PC LAN is not required to accept an order at an incorrectly displayed price merely because the order was submitted or payment was authorised, processed or received. Where a displayed price is clearly inconsistent with the normal selling price, market value or pricing of the relevant product, PC LAN may investigate the price before accepting the order.

Prices, discounts, promotions and availability may be changed, corrected or withdrawn before an order is accepted. Once an order has been accepted, PC LAN's rights concerning a genuine mistake remain subject to applicable law.

Product Images

PC LAN makes reasonable efforts to display accurate product images. Images are provided primarily for product identification and illustration and may be supplied by manufacturers, distributors or other third parties.

An image may differ from the exact product supplied in relation to packaging, product revision, regional labels, minor cosmetic details, colour appearance caused by a screen or photograph, or optional accessories and demonstration items shown but not included.

Please refer to the product title, manufacturer part number, model number, specifications and description to determine what is included. If there is a material inconsistency between an image and the written product information, please contact PC LAN before purchase for clarification.

PC LAN will not knowingly substitute a materially different product solely because an image is described as being for illustrative purposes.

Product Descriptions & Specifications

PC LAN makes reasonable efforts to ensure that product descriptions and specifications are accurate and current. However, information obtained from manufacturers, distributors, suppliers or other third-party sources may occasionally contain technical inaccuracies, outdated information, typographical errors or omissions.

This may include information about processor models, memory, storage, graphics, display size or resolution, connectivity, operating systems, included accessories, dimensions, weight, compatibility, warranty, model numbers, manufacturer part numbers, pack quantities or other technical specifications.

Usable storage capacity may be lower than the advertised capacity because of formatting, pre-installed software and recovery partitions. Recovery media may not be included with some desktop and notebook products.

Manufacturers may revise products, packaging, specifications, firmware or included accessories without prior notice. Customers purchasing for a specific technical requirement, compatibility requirement or application should verify the manufacturer part number and relevant specifications before purchase.

If PC LAN identifies a material description or specification error before accepting an order, PC LAN may correct the information and give the customer the option to:

  • proceed based on the corrected information;
  • select an alternative product; or
  • cancel the affected item and receive a refund of any amount paid for it.

If you receive a product that you believe materially differs from the description under which it was purchased, please contact PC LAN promptly so we can review the matter. Nothing in this section limits any right or remedy under the Australian Consumer Law.

Product Listing Errors

A product listing error may include an incorrect product title, description, manufacturer part number, SKU, model, generation, specification, operating system, warranty, compatibility statement, included accessory, quantity, pack size, image, bundle component, promotion, stock status, estimated availability or other product characteristic.

If PC LAN discovers a material listing error before accepting an order, it may correct the error and offer the customer the choice to proceed with the corrected information, select an alternative product, or cancel the affected item for a refund. PC LAN will not intentionally substitute a materially different product without the customer's agreement.

Product Availability

Product availability is subject to change. Stock quantities and availability displayed on the PC LAN website are indicative only and may not reflect real-time stock levels.

A product shown as available or in stock when an order is placed may later become unavailable or be placed on backorder due to simultaneous sales, supplier stock changes, distributor allocation, warehouse discrepancies, damaged or missing stock, supplier cancellation, manufacturer discontinuation, or delays in inventory or supplier-data synchronisation.

A status such as "In Stock", "Available", "Special Order", "Backorder" or "Pre-order", or an estimated arrival or delivery date, does not guarantee availability or a particular date unless PC LAN expressly confirms otherwise.

If a product becomes unavailable before order acceptance, PC LAN may:

  • place it on backorder with the customer's agreement;
  • provide an estimated arrival time where available;
  • offer an alternative product for the customer's consideration; or
  • cancel the affected item and provide a refund.

Any arrival or delivery date provided by PC LAN is an estimate unless expressly stated otherwise. Supplier and freight delays may occur outside PC LAN's reasonable control.

Supplier and Manufacturer Information

Product specifications, images, stock information, estimated arrival dates and pricing information may be supplied by manufacturers, distributors, suppliers or third-party data providers. PC LAN takes reasonable steps to maintain accurate information but cannot guarantee that third-party data will always be error-free, complete or immediately updated. PC LAN may correct information when it becomes aware of an error. This does not limit PC LAN's obligations or a customer's rights under applicable law.

Manufacturer Changes and Product Revisions

Manufacturers and suppliers may change product specifications, packaging, included accessories, model revisions, firmware, warranty arrangements or other characteristics without prior notice. If PC LAN becomes aware before order acceptance that a change materially affects an ordered product, PC LAN will, where reasonably practicable, notify the customer before proceeding. PC LAN will not knowingly supply a materially different substitute without the customer's agreement.

Delivery & Store Pickup

All orders are subject to confirmation and acceptance by PC LAN. PC LAN or its delivery agent will deliver goods to the address specified in your order within the agreed timeframe, subject to availability and delays outside PC LAN's reasonable control. If goods are unavailable, we will notify you as soon as reasonably practicable.

You are responsible for providing complete and accurate delivery details. A person who accepts goods at the nominated delivery address will be presumed to be authorised to receive them, unless PC LAN has agreed to a different delivery arrangement.

If the law prescribes a minimum age for a product, you must meet that age requirement and ensure an appropriately aged person is available to accept delivery. PC LAN or its carrier may require proof of age and may refuse delivery where satisfactory proof is not provided.

If delivery cannot be completed because no authorised recipient is available, the address is incorrect or access cannot be obtained, PC LAN may charge the reasonable cost of redelivery or return-to-sender handling, subject to applicable law.

For store pickup, PC LAN may require the purchaser or authorised collector to provide suitable identification and order details before releasing the goods.

Title & Risk

Title to goods does not pass from PC LAN to you until PC LAN has received payment in full. Risk in the goods passes to you on delivery to you or your nominated recipient, except where applicable law provides otherwise.

Returns Policy & Refunds

Product returns are subject to PC LAN's Returns Policy, which forms part of these Terms & Conditions. Nothing in that policy or these Terms & Conditions excludes, restricts or modifies rights that cannot lawfully be excluded, restricted or modified.

Disclaimer of Liability

To the extent permitted by law, PC LAN is not liable for indirect, special or consequential loss arising from use of this website or a breach of these Terms & Conditions where that loss was not reasonably foreseeable. This clause does not exclude liability for loss caused by PC LAN's negligence, breach of contract or unlawful conduct to the extent that liability cannot lawfully be excluded or limited.

Disclaimer of Warranty

This website and its Content are provided on an "as is" and "as available" basis. PC LAN takes reasonable steps to keep Content accurate and current but does not guarantee that the website will always be uninterrupted, error-free, complete or current. Nothing in this clause excludes any guarantee, warranty, condition, right or remedy that cannot lawfully be excluded.

Limitation of Liability

Where permitted by law, and where goods or services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, PC LAN's liability for failure to comply with an applicable statutory guarantee may, at PC LAN's option, be limited to:

  • for goods: replacement of the goods, supply of equivalent goods, repair of the goods, or payment of the cost of replacement, equivalent supply or repair; and
  • for services: supplying the services again or payment of the cost of having the services supplied again.

This limitation does not apply where it would be unfair or unreasonable, or where liability cannot lawfully be limited.

Rights We Cannot Exclude

Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

Suspension or Termination of Website Access

PC LAN may suspend or terminate a person's access to an account or ability to place new orders where reasonably necessary because of a material or repeated breach of these Terms & Conditions, suspected fraud or unlawful activity, a security risk, harm to PC LAN or another person, or a legal requirement. Suspension or termination does not affect an order already accepted, accrued rights, or rights that cannot lawfully be excluded. Provisions intended by their nature to survive termination will continue to apply.

3. Fair Trading Policy & Consumer Guarantees

PC LAN is committed to complying with the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, and applicable fair trading laws.

Benefits provided under a manufacturer's or PC LAN's express warranty are in addition to other rights and remedies available under law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

6. OEM Policy

You may purchase an OEM software product only if:

  1. you are a computer technician, IT consultant or computer reseller; or
  2. you are assembling a PC system and satisfy the relevant manufacturer's licence requirements.

PC LAN may refuse the sale of OEM software where the customer does not satisfy the applicable eligibility or licence requirements. If PC LAN refuses the sale, amounts paid for the affected OEM software will be refunded. PC LAN takes reasonable steps to support manufacturer OEM policies, but the customer is responsible for ensuring that its purchase, installation and use comply with the applicable licence terms.
